1. General

Lucy is a mobile application that provides guided stretching routines and a timer that counts you through them.

By downloading, opening or using Lucy, you agree to these Terms. If you do not agree to them, do not use the app.

You must be old enough to form a binding contract where you live, and you must be able to make your own decisions about physical activity. The app is rated for general audiences but is written for adults.

2. What the app provides

Lucy provides:

  • guided stretching routines made up of individual stretches
  • a timer that moves through each stretch and signals when to change sides
  • suggestions about which routine to do, based on answers you give during setup
  • a record of the days on which you completed a routine

Everything the app suggests is general fitness guidance. It is not tailored to your medical history, and it is not adapted to any injury, condition or symptom. Routine suggestions are produced by simple matching against the preferences you entered — they are not a clinical assessment of you and are not personalised in any medical sense.

The app does not provide, and does not claim to provide, weight, load or resistance recommendations, and it does not generate programming automatically.

3. Your responsibilities

This is the most important section in this document.

You are responsible for deciding:

  • whether you are well enough to stretch at all
  • whether a particular movement is appropriate for you
  • whether a suggested duration is appropriate for you
  • how far into a stretch to go, and when to stop
  • whether to attempt a routine, skip it, or do something else
  • whether your surroundings are safe for the movement

You must use your own judgment every time you use the app. If a stretch is painful, uncomfortable in a way that concerns you, or simply feels wrong for you today, modify it, shorten it, skip it, or stop.

The app is built to let you do this. Every stretch duration can be adjusted, and any routine can be ended at any moment without consequence. Using those controls is expected use, not failure.

4. Health disclaimer

Lucy provides general fitness and stretching information. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for a qualified healthcare professional.

If you have an injury, a medical condition, have recently had surgery, are pregnant or recently postpartum, or have any other health concern that could affect your ability to move safely, consult an appropriate professional before using the app.

5. Assumption of risk

Stretching and physical activity carry inherent risks, including injury. By choosing to perform movements suggested by the app, you accept those risks knowingly and voluntarily.

This does not mean we disclaim everything in every circumstance — see section 9, and in particular the carve-out for liability that cannot lawfully be excluded.

6. No guarantee of results

We do not promise that using Lucy will make you more flexible, reduce stiffness or discomfort, improve your posture, or produce any other physical outcome.

Results vary substantially between people and depend on factors entirely outside the app's control, including consistency, physiology, age, health and history. No statement in the app, on our website, or in our App Store listing should be read as a promise of a particular result.

7. Fitness information changes over time

The content in the app reflects general, widely-held guidance about stretching at the time it was written. Understanding of exercise and movement continues to develop, and specific recommendations change with it.

We therefore cannot guarantee that all content reflects the most current research at any given moment, or that any particular movement is the best choice for any particular person. We will make reasonable efforts to keep content current.

8. Third-party equipment, surfaces and services

You are responsible for anything you use while stretching — a mat, a chair, a wall, a doorway, the floor — and for the space you use it in. We do not inspect, supply, test or maintain any of it.

Lucy is distributed through the Apple App Store and uses third-party services to operate (see the Privacy Policy). We are not responsible for the availability or behaviour of those services, and your use of the App Store is governed by Apple's own terms.

The app does not currently connect to Apple Health, wearables, or any external fitness device.

9. Limitation of liability

To the maximum extent permitted by applicable law, and subject to the carve-out below:

  • the app is provided "as is" and "as available"
  • we are not liable for indirect, incidental, special or consequential loss
  • our total aggregate liability arising from your use of the app is limited to the greater of (a) the amount you paid us in the twelve months preceding the event, or (b) [MINIMUM FLOOR — LEGAL REVIEW]

Carve-out. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Depending on where you live, that may include liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and rights you hold as a consumer that cannot be waived by agreement.

Where applicable law gives you rights that these Terms would otherwise restrict, those rights prevail and the rest of this section applies only so far as the law allows.

10. Subscription and payments

Lucy offers both free and paid content.

Free. One complete routine is free permanently and requires no payment, subscription or account.

Lucy Premium. A subscription unlocking the remaining routines and adjustable stretch timings. Offered as a monthly or annual plan, with an introductory free trial where shown at the point of purchase.

  • Purchases are processed by Apple, not by us. We never see or hold your payment details.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel a subscription in your Apple ID settings. Cancelling stops the next renewal; it does not shorten the period you have already paid for.
  • Refunds are handled by Apple under its own policies. We cannot issue refunds for App Store purchases directly, though we will help where we can.
  • Where you have statutory cancellation or withdrawal rights as a consumer, those rights are unaffected by this section.

Prices are shown in the app before purchase, in your local currency.

11. Privacy

How we handle data is described in the Privacy Policy.

In short, and as of this version: Lucy has no user accounts and does not ask for your name, email address or password.

12. Acceptable use

Do not attempt to circumvent payment, interfere with the app's operation, or redistribute its content as your own. The routines, illustrations, copy and design are ours or licensed to us.

13. Changes to the service

We may add, change, remove or improve features. We will not remove access to content you have already paid for during a period you have paid for.

14. Changes to these Terms

We may update these Terms. Where a change is material, we will tell you in the app and, where appropriate, ask you to accept the updated version before continuing.

The version you accepted is recorded, so it is always possible to establish which Terms applied to you and when.

15. Governing law and disputes

FINAL LEGAL JURISDICTION REVIEW REQUIRED

Unresolved and dependent on:
  - where the company is incorporated
  - where it operates from
  - which markets the app is sold in (currently 175 territories)
  - consumer-protection rules that override choice of law in the EU, UK and
    elsewhere, regardless of what is written here
